My husband cheated on me, and I have all the proof. I tried giving him a second chance so we could work on our marriage. We both tried, but it simply isn’t working out. Our families recently met, and he stated that he wants a divorce. During a private one-on-one discussion, he offered to return the maximum possible amount my father spent on the wedding, along with reimbursing the household expenses we incurred. He also agreed to sign a stamped, legally binding affidavit to formalize this security. Now I am torn: Should I accept his offer, or should I file a legal case against him for adultery, mental harassment, and the damage I’ve suffered? My biggest concern with taking the legal route is the immense stress, time, and money involved. I worry the legal battle will get ugly, as he will likely go to any length to protect himself and his family. To be clear: This is not about being greedy or trying to get easy money. I poured everything into this marriage at the cost of my own peace of mind, and I never made unreasonable demands. For anyone who has been through the legal process: Is a contested legal battle worth the toll it takes, or is it better to accept his settlement offer and move on?
This situation highlights a painful trade-off: the pursuit of legal vindication versus the immediate preservation of personal peace. The husband’s offer provides a structured, predictable path to financial reimbursement, backed by a legal affidavit. It promises a relatively swift resolution to a marriage that is already recognized as unsalvageable. However, accepting it might feel like letting him control the terms of his exit without facing formal, public accountability for the emotional damage.
Choosing the legal route, conversely, offers a platform to address the mental harassment and infidelity. Yet, as the writer astutely notes, this path introduces massive unpredictability, high financial costs, and prolonged emotional distress. A hostile legal battle could turn what is currently a quiet negotiation into a war of attrition where both sides suffer. The core decision rests on whether the potential validation of a court judgment is worth the guaranteed toll of obtaining it, or if reclaiming one's peace of mind quickly is the truer victory.

Settlement outside the court is best. I'll suggest not to go legal because the stress that you will get throughout isn't worth it. It will be massive , trust me. Convince him to give you maximum compensation and start your life again. That's the best solution to this kind of discord. Sometimes to teach a lesson to the person we take the tough route. But in the process we end up wasting our peace of mind and energy. Therefore, be mindful.
Legal battles leave no clear winner
Don’t decide emotionally. First consult a good family lawyer and understand what you’re legally entitled to. If the settlement is fair, properly documented, and gives you peace and financial security, moving on may be better than a long legal battle. Protect your future, not just your anger.
Dont go for legal. Its very time consuming process. Why to fight if things getting sorted easily. Better to choose first option.
Legal system has gone to dogs.. just a hint .. hope you got it
Jab koi aapse pyar nahi karta usse zabardasti rehane ka matlab nahi banta sabse badi saazaa usse khamoshi se nikal jaana
Its good that he is offering you all the expenses (to cover up anything), even the household ones.. you should blindly accept it without a second thought. You already are in a lot of stress.. Legal battles are ugly as hell; even if you win is a time consuming process with add on stress. You might get verdict in your favour after 7-10yrs but by that time you might even not be interested in that validation or win since 100% of your energy is already been wasted along with your age. I can guarantee you after 3-4yrs you will be in a mentality of “fuck everything and give me my peace back, i dont even this win”.. I can feel you that you are thinking of legality just to show how wrong he is, to punish him and once proved, you will get peace at heart but believe me sister- after few years this is not even worthy. So, there is nothing being greedy here but just take the money and everything belongs to you and restart your life. All the best👍
Settle outside the court and extract as much as possible to secure your and your kids future and don't invest emotionally on such a relationship anymore . But yes...as someone rightly advised , consult a good trusted lawyer " through reference " and understand your position first
Being an advocate, I would suggest you to settle the matter amicably and go for mutual divorce, you will come out with your mental peace and dignity intact. Contested divorce is all about mudslinging and washing your dirty linen in public, at the end of it all, you will get divorced. Why do want to go through hell to achieve the same result at the end!
Sister, first - what you are feeling is completely valid. Giving a second chance after cheating takes huge courage, and when it doesn't work, it hurts even more. Since you asked practically - here's how most women in this situation think: Settlement lene ke fayde: 1. Peace and closure fast - Court case in India for adultery/cruelty can easily drag 3-5+ years, with multiple dates, stress, money to lawyers. 2. What he's offering - wedding expenses + household reimbursement + stamped affidavit - is actually more than what many get after a long fight. Many husbands offer nothing. 3. You avoid an ugly battle where he will try to protect his family and drag you. But BEFORE you accept, please do this: 1. Get that affidavit vetted by YOUR OWN lawyer, not his. Don't sign anything in private without legal advice. Make sure amount, timeline, mode of payment, and that he won't claim anything back later is clearly written. 2. Check if amount covers everything - your jewellery/streedhan, any joint savings, future security. Wedding expense is not your only loss, your 2-3 years, mental health, career break also matters. 3. Ask for one-time lump sum via DD/RTGS, not promises of "later". And include clause for mental harassment closure. 4. Talk to a family lawyer once - many give first consultation free. Under HMA Section 13, you have grounds, and you are entitled to more than just wedding cost - you are entitled to alimony for your future. If the settlement gives you financial safety to start fresh and peace of mind, taking it is NOT greedy, it's smart. Fighting for punishment feels right emotionally, but sometimes moving on with money and peace is the real win. Don't decide in family pressure. Take 2 weeks, consult a lawyer, then decide. More power to you.
If u go to court, it will jeopardize your marriage
Go for one-on-one out-of-court settlement, legal battles will drain you more, not worth it... end of the day situation will be worse & you will be completely torn! Better opt for your peace & good health.
How long you were married? Since you haven't mentioned I'm assuming you don't have kids --- 1. Dowry/Gifts given to husband & his family 2. Expenses on wedding and before after functions 3. Day to day expenses which you had paid for 4. (1 or 2 or 5 lakhs * no of years marriage lasted) First take all this money and then go for mutual divorce.
My humble request is to go for settlement outside the court... Get the max out of it.. Here think in terms of financial security. At least your father will be relieved at one point of time and later you can decide on your next phase of life.
Don't go for legal... accept everything and let karma do its part...if peace is important for you, leave and live....
u opt for the first option to settle and go without any worries...second one going legal is long way and wont look good for both of u as he has already made up his mind
What are you going to file a complaint about? Adultery is not a crime as per law. You can file a case to get a better settlement. But you cannot punish him through law for cheating unless he did any physical violence. In that case definitely you can file a case and punish him
Go for the legal battle...maza ayega🤣
You can easily figure out which amount will be making your life easy. Just ask for that. Avoid court battles. It will waste time.
Consult a lawyer first. Maybe it's his plan to avoid responsibility and commitment. Be aware
In matrimonial cases both the husband and wife lawyer do the partnership and drag the case like anything for a decade. They both can earn together with you both(husband and wife). Don't waste time and peace.
She doesn't want to admit it but she wants more money. 🤣
Go girl get a life .... Choose a settlement or whatsoever but stay away from court i can understand this and can relate too.... Here my husband re-married without giving divorce and I am here paying of court fee my expenses and my son's only even I didn't demanded for a penny still he is not coming to the court after the warrant has passed from the court he has shifted to somewhere else but in the same city.... And i am here looking after my child who is having speech delay and my mother who is mentally retarded mute and deaf too ..... Better to choose a life and restart it nothing is more important than being happy...... Trust me you will not only choose separation but ur stress free life ,your health , and a chance for yourself...
If you go legal, you will face a lot of difficulties and it's late and long process. You may not be able to win with the current system like police, court etc. Go with the Settlement !!
Adultery is not a crime acc to indian judiciary
Legal cases can go for 5-10 years on average (if contested by both sides). So try to avoid that at all costs.
Just take the settlement. The legal battle is usually long n exhausting. Be practical.
You want justice for your pain, which is completely understandable. But courts rarely provide emotional vindication; they usually just drain your time, money, and sanity. If his financial offer is fair, have a lawyer review the affidavit, take the settlement, and walk away. Punishing him is not worth staying trapped. Choose your own peace.
His body his choice. If you want to leave, pay him.
Msg me
Madam, legal way is stressful and may be long drawn, but as he cheated and you have the proof of adultary, you have the upper hand...what he is offering is the bare minimum, if he really value his or his family's name and "honour" he should overcompensate you for your lost time and the effort you put in the marriage...please consult a good family lawyer, try to avoid the difficult legal battle but ask for more money. The man should be taught the price of cheating.
He has cheated and involved in adultry. No point living with him. Going legal way is very time consuming and energy draining. After legal battle things ll get ugly n he ll change his mind on settlement. So get proper settlement and come out of this toxic life and start fresh. He ll get what he deserve at the end anyways.
Bargain for a good amount and move on.. legal route takes years and don’t think that is the better option.
Take the money and run. Rebuild your life. Live happily ever after
Rightly said, any battle will end up devasted. Try to maximise your settlement accept and move on to peace of living
No need to file cases to destroy your peace of mind, try to take maximum money and move on, mental peace is far far more important than court hassles
Get out of it amicably!
Take the money so much that you don't have to think about earning money at all....and live like Queen..... explore places....tarvel
it's not working out, better get settlement and move on for mutal divorce and end the procedure, then look on for your own life, legal battel is so time consuming it will easyily takes upto few years...
Best outside settlement remember in the name of legal battle the lawyers will make a fortune out of u. This world is not so straight as we think go in for a settlement out of court and let him go for what good he has done for you
Get out of court settlement . Legally it will take a toll on your money health peace of mind , your hubby that *** is ready for out of court settlement then go gor that . At the same time make sure the monetary thing which he is ready to give you is good enough for you to live a good life. Also get a written affidavit from him signed in the presence of your lawyer and witness that in future he will not trouble you in any way , orget in touch with you in any way , the settlement which happens in stamp paper is full and final and he agrees to all the conditions written in stamp paper affidavit and is not under any pressure and is of sound mind when he signed the affidavit on that day. End this cheater hubby's chapter forever Girl.
As a lawyer I would say take the offer and end marriage amicably, you’ll save yourself from mental harassment legal system causes.
Get out Sister. Start your new life.
Do it legally
No use of living with the person who is not interested in living with you. Like women walk out of marriage giving any reason, he can also do that. Also, having extramarital affair is no more a crime so save yourself from court, dates and years, move on. Whatever decent he can afford and you think is right and get divorce.
First understand, there was no love envolvef in the marriage and you have to move for your peace and bright future..no point of fighting for the things those are not yours..might. E a good sign that you gonna have best soon..leave the crap over your head as soon as possible without letting go your rights and move on..Wish good luck Healy and best of live in the world 😊
Every other women 👩🦰 i dont want money not a gold digger ,but also every women👩🦰 "I WANT MONEY".
Take the money, get out. Rebuild your life, do something good for yourself. Just forget this sordid chapter if your life.
Legal battles will benefit 2 people, your lawyer and his lawyer..... You both will loose
You not taking money and settling outside the court will make you respect yourself and your soul..... Rest it's your wish
Get ready to handle more expensive stress and it may take a decade or more..
you must take money and keep quiet
How many years were you married for? Do you have any kids? What other harassment did you face during this relationship? We know nothing and you want us (or random people on internet) to tell you what to do?
Going legal was time waste and money waste, sit with your from elders both side, discuss monetary support, then take mutual divorce. If you meet a greedy lawyer, then you are gone.
Not worth it will waste time money. It can be dragged for long without resolution, leave ur ego quit it accept the money move on.good for ur peace
Accept n move on
Why are you labelling as your confession. Settle out of court do better negotiation and but get legally mutual divorce if you are going to contest then you would may end up in old age for settlement neither you will get another companion
Better to take the money and move on. Do you have any kids?
Better take out of the court settlement court and legal proceedings will be very tiresome
People in the comments, sorry MEN. Shaming her to be a gold digger and that she wants extra money, nobody is talking about what her husband did to her. PATRIARCHY
Go legal, you have more chances to extract money through that way. Screw him
Dont be stupid ...legally,cheating isnt a punishable offense...Dont ask for marriage and household expenses only...if you want to make him regret, get more money like 1C or a house he has that has to be registered in your name...men regret the loss of komey only not wife,so dont be an emotional fool or that you dont want his money nonsense... you wasted your time an d youth on this fool,so make sure you are compensated atleast Dont sign the divorce papers or agree for it unless he gives the amount in cash with no proofs of transaction
Are u so ugly that no one bother to marry you. Get the money from your husband and find a new one. Dont stick to a failed relationship
Even if he has tried to pay the maxm that he could, yet you are trying to punish him. According to supreme c**t, adultery is not a crime but a valid ground for divorce. Take it. Why wanted this husband of yours to be punished. Don’t you believe in fate? Or did you really fail him too in some manner that he failed you?
What an idiot you are... Ask him if he wants to stay or call it a day instead of creating unnecessary drama
