My parents are divorcing after thirty-six years of marriage

Hi M 35 My parents are discussing divorce after 36 years of marriage because of my father's extramarital relationship. My mother gave him several chances and enough time to change, but unfortunately, he did not. Now, my mother has asked him for a divorce and wants him to transfer the properties into her name. These properties were originally earned by my grandfather, my father's father. My father has agreed to give her a divorce and transfer the assets to her name, but he refuses to provide her with any monthly maintenance or a lump-sum settlement. My mother has been a homemaker throughout her married life, and she is now 54 years old. How can we ask my father to provide her with maintenance? He runs a business that generates approximately ₹3 lakh per month. It is not that I am unable to support my mother financially. I can support her if necessary, but she is adamant that she wants financial support from my father because she believes that it is his responsibility to provide for her after their long marriage. Would appreciate everyone's opinion thank you

Brother, first of all respect to your mother for taking this tough decision at 54 after giving so many chances. And respect to you for standing with her. Your mother is 100% right to ask for maintenance, and legally she is strongly entitled to it. A few points that might help you: 1. Property transfer is NOT a substitute for maintenance. Properties that came from your grandfather are ancestral from your father's side, but after 36 years of marriage as a homemaker, she has a clear right to maintenance for her future security. 2. Under Hindu Marriage Act Section 25 (Permanent Alimony) and Section 125 CrPC, a homemaker wife after a long marriage is entitled to maintenance to live with similar dignity. With your father earning ~3L per month, court usually considers 20-25% as a benchmark, but it depends on many factors. 3. Since he is already agreeing to transfer properties, get EVERYTHING written in a formal MOU/Settlement Deed through a good family lawyer - don't do it verbally. Clearly mention "property transfer + monthly maintenance/lump sum" both. 4. Lump sum one-time settlement is often cleaner at this age than monthly fights. If he doesn't want monthly, ask for a decent one-time amount that can be put in FD for her monthly expenses. She is not asking for charity, she is asking for her right after giving 36 years as a homemaker. You can support her, but financial independence from him is important for her self-respect. Please consult a good family lawyer in your city, don't settle this at home only. Wishing strength to your mom 🙏

Ur mother is right tho. It is indeed ur father responsibility to provide for her after their long marriage especially when he is at fault. You can help ur mother in ur capacity, but the primary responsibility lies on ur father. Better don't poke ur nose unnecessarily between them too much. U never know what kind of exact relationship they had.

If those assets revenue why does she need extra income at her age. If your dad was never happy with her, introspect why? What made him unhappy in this long relationship with her? What's her neg factor in a marriage

If your father agrees to transfer property to your mother then let your fathers gf know about this..At this age Womens target Mens only because of property.The moment she came to know she will leave your father..

She should get an equal share in the assets along with monthly maintenance from your father. You need to consult a good lawyer.

AsSalaam O Alaikum Bhai Your mother is 100% correct in her stance. After 36 years of marriage as a dedicated homemaker, securing independent financial support from her husband is not a matter of charity or family favor—it is her legal and moral right. ​Even if your father transfers the family ancestral properties to her name, property assets (like land or a house) are non-liquid. A 54-year-old woman needs consistent, monthly cash flow for healthcare, daily expenses, and living costs without having to rely on her children or liquidate real estate. Property transfers solve housing security, but maintenance solves living security. Your father cannot trade non-liquid ancestral assets to escape his statutory duty of providing monthly maintenance. Hold firm during negotiations until both property titles and monthly financial support are legally secured.

So she wants property and maintenance, wow. Either go for 🤑 or property, if she is 54 the your father must be elder than her and need little peace in his golden hours. By snatching money and property both, how do you think he would survive? If he is not happy in this marriage, then divorce is his right, although the legal system and society won't agree with him comause HE IS A MAN AND AN ATM FOR EVERYONE.

He should not divorce her and not give her a single penny . She should have worked while married and built her own properties with him . It’s not her money

Ur mother is doing right thing. Just make sure it father reproduce more step bro sis for u. If he does then .. ur moms propert will eventually be yours and u will get property from ur father also.

Your mother is just being greedy and petty because she is hurt. You can't have your cake and eat it too. If she is getting 100% of the assests, then there is no alimony. But if your dad was only giving part of the assests, then she can make a claim. The way you described it, she wants all the assets and alimony. Don't forget, on the other side is your dad to. He may have wronged your mother, but he is still your father. And he has expenses also and a life to live and fund. Your small mind is only seeing the 3 lac he generates from his business, what about the rest of his expenses. And for 36 years you and your mother and family were also his expense
