#C27123 25, F I'm writing here to seek a genuine suggestion. Two months back I joined an organisation with a monthly pay of roughly 11k. I wasn't satisfied with this offer but since I had no prior experience i couldn't get into any reputated mainstream school. The place which I joined is somewhat toxic and people aren't so nice. But I kept going as i wanted to support my parents with whatever little I was earning. Now by god's grace I secured a position in a reputed school with a much higher pay. It all happened so suddenly that my new working place is willing to give me a month time to get all the necessary release documents and everything. The problem is the organisation I'm working rn told me that I can't leave the organisation before i complete atleast a year with them. They told that when I joined as well. But there is no written documentation. But they are not giving me a release letter or an experience letter. I told them I won't be able to serve one month of notice period so I will compensate with my one month worth of salary. How to get the release letter if you all can suggest me any ways.

Do some nunnu massage to the authority and get your work done . 🤣🤣🤣🤣🤣
Just go to labour court & ask them you'll file case as they don't have any written docs with them about the bond period.

Did they give you an appointment letter?? Did you sign any documents related to job tenure? Don't reveal the new school name to anyone not even your closest friend. Job experience is given only after you complete 1 year
Kindly DM with the joining letter copy, and I can let you know the legal provisions that would apply
No body can detain other against will. See if you have other documents so that new employer hires you. Give them formal resignation letter with one month notice & request for relieving forthwith after completion of notice period. After completion of notice period give them a letter that you will move labour commissioner for unfair labour practice & also compensation for harassment . You can send notices by RPAD if the company refuses toacknowledge ment
If they have not given you proper appointment letters on their letter head signed with date and terms conditions what rules they are talking about ?? Beta file your complaint here . Bring pressure from government of India labour department. New Delhi. Seedhi ungli se baat nahi bane , toh ungli teda karke ukhaad dena. That's my style 😎 https://samadhan.labour.gov.in/faqs
1. Check your offer letter from the current school. If there is any such clause that binds you, and you have signed it, then there is no option but to negotiate with them. There must be an employee handbook or manual, try to get hold of it and go through it. 2. Make a written application or mail that you need to leave for medical grounds and you can give up 1 months salary for that, if needed. Written application is necessary. 3. If there is no written clause that you have signed, it's easier. Either way move to the labour court. Make application. You may also write a mail to the women commission. 4. Talk to the new school administration, if they need a release letter or experience letter. If yes, step 1-3 will help. If not and they only need a payslip, bank statement and previous offer letter, then you're good already. You just need to sacrifice your experience letter for the tenure you have completed in the current school. Whatever you decide, make your application logical, transparent and early so that you can still have time to work on the replies you received. Whoever is asking for your current school's offer letter and willing to help, you may share it but do not share the name or offer letter of the school you are intending to join. All the best.
why do you need service certificate from them was there any appointment letter. what are terms and conditions on exit
No need experience letter Pay them and leave
If your future employer doesn't need Exprnc letter, then just leave.......
Have eye to eye with you current boss or manager and tell him ( don't pledge) just tell him if they don't release you be ready to explain in labour court... And you'll be released
You put a resignation mail to the organisation mentioning the Notice period you are willing to serve. If the Notice period is less than that is mentioned in your current organisation offer letter then mention that you will pay the amount to compensate the difference. They will definitely relieve you as per your request as they know that we can go to the labour court and file a case against them showing the offer letter and this mail as an evidence.
They can’t legally force you to stay for a year based on a verbal condition. Resign officially and escalate to labour office if harassment continues.
Just leave without any releving letter and last month salary and join new school.
Ping me with ur offer letter. Will guide u
File a complaint with DIOS. Also contact a good labor lawyer and send a legal notice. This will also include Labor commissioner, PF and all the mandatory shenanigans. The school probably has never been challenged and hence they think they can bully every body. Oh and send your resignation confirmation again via registered post and or email. You should have a proof that you resigned and that they acknowledge that you have resigned.
As there is no documentation of that 1 year contract... When your salary gets credited just leave and don't go. And ask your current HR for joining what documentation they need... If that includes the release documents then just convey the whole thing. They are also aware of what toxic organisations could do. Just take your salary and leave... I also had a similar experience as a fresher...you can inbox me with the offer/appointment letter.
