#C27111 I am working in a company which is based out of Delhi, and I am working in Bangalore as Senior manager strategy, and I am working with this organisation from past 7 years. On last month I got delivered my baby. Technically I am on maternity leave for 6months , but in this phase as well , company is forcing me to work , as I am not able to (I have not even done with one month of maternity leave) , they aren't paying my salary, and when I am asking for the salary, they are just making excuses or threatening me. Kindly help me on the same , I really need a help badly. TIA

Technically you donot need to work as it's your paid maternity leave ..if it's unpaid then you need to see ur company policy for maternity leaves . rest your choice ...

If it's a registered company in India paid maternity leave is mandatory. You will get a salary without any need for working during this period. If your company cannot or is not paying, you can take them to court. There is never any internal policy a company can implement if it's in India. They will lose their licenses to operate in this country. Don't worry law is with you. They can't threaten you. They can't ask you to work. They cannot ask you to quit or terminate you. They have to pay you no other option. This is law, cannot be any internal policy.

maternity leave policy is applicable all over the world and India also we have it...no one can stop ur salary...u can sue them if they torture u like this...they have to pay u the salary as per law...take this to hr and if they dont take action tell them u will take action if they dont follow law

Consult a lawyer who has expertise in corporate cases, Send a legal notice and that might work for you, but be prepared for the legal fight mentally and if you are financially able to handle it in case you need to resign from this stupid company

Check your appointment letter and maternity leave policy with HR, which may be on intranet internally, companies can't bypass labour laws
